Filebrary respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines how we handle claims of copyright infringement in compliance with the DMCA (17 U.S.C. § 512).

If you believe that your copyrighted material has been uploaded or shared on Filebrary without authorization, you may submit a DMCA takedown notice as outlined below.

1. Filing a DMCA Takedown Notice

If you are a copyright owner or an authorized agent acting on behalf of the owner, you may submit a written notice requesting the removal of the allegedly infringing content. Your notice must include the following information:

Your Contact Information

• Full legal name.
• Email address and/or phone number.
• Physical address.

Identification of the Copyrighted Work

• A description of the copyrighted work you believe has been infringed.
• If multiple works are affected, you may provide a representative list.

Identification of the Infringing Material

• The URL(s) or specific location(s) of the allegedly infringing material on Filebrary.
• Enough detail to help us locate the content in question.

Statement of Good Faith

A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

Statement of Accuracy and Authorization

A statement, under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Electronic or Physical Signature

Your physical or electronic signature (e.g., typing your name at the end of the notice).

2. Response to DMCA Takedown Notices

Upon receiving a valid DMCA takedown notice, we will:

i. Remove or disable access to the allegedly infringing material.
ii. Notify the user who uploaded or shared the content about the removal.
iii. Provide the user with a copy of the DMCA notice and instructions for submitting a counter-notification if they believe the content was removed in error.

3. Filing a Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

• Full legal name.
• Email address and/or phone number.
• Physical address.

Identification of Removed Material

A description of the material that was removed or disabled, including its location before removal.

Statement of Good Faith

A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.

Consent to Jurisdiction

A statement that you consent to the jurisdiction of the federal court in your district (or the district where your address is located) and agree to accept service of process from the party who filed the original DMCA notice.

Electronic or Physical Signature

Your physical or electronic signature (e.g., typing your name at the end of the notice).

Send your counter-notification to:

If your counter-notification is valid, we may restore the removed material unless the original claimant files a lawsuit against you within 10 business days.

4. Repeat Infringers

Filebrary reserves the right to terminate user accounts that are deemed repeat infringers. This determination is at our sole discretion and is based on the number and nature of DMCA notices received.

5. Misrepresentation

Any person who knowingly submits a false DMCA notice or counter-notification may be held liable for damages, including costs and attorney's fees, under Section 512(f) of the DMCA.
